In general, applicants with the application must demonstrate their compliance with this rule. If they fail to pass a test of compliance with the minimum requirement to meet the requirements outlined above, they shall be dismissed from the program immediately. If the applicant is a child or an adult living on the premises, they shall not be transferred to a new program.

In all instances with the application in excess of one kilogram of pesticide, an inspection of the premises shall be performed at the site of the application. If the inspection is conducted to determine the toxicity of a substance or component of a pesticide, a report, and subsequent reports are considered on the basis of the presence or absence of a significant amount of it in evidence. The investigation shall be conducted by the state director of state wildlife services.

D. If there is evidence that the applicant is using nonhazardously labeled pesticide, they shall be provided a new notice that is signed and dated by the department.

E. Any person who violates conditions set forth in Section 3.2 of this rule as follows:

(1) violates the requirements of paragraph (b) (see Subparagraph 12C of Rule
